Doug receives many requests each year from solicitors to provide employment reports to support litigation in personal injury, clinical negligence, criminal injuries and fatal accident cases. Instructions are received from both Defender’s and Pursuer’s solicitors.
In most cases the focus of the reports is to comment on the impact of injury or illness on someone’s future employment prospects and earnings potential.
Reports are prepared on the basis of an interview with the Pursuer whenever this is feasible, assessment of the Pursuer’s employment related issues, a review of case papers provided and research undertaken which is specific to each instruction or case.
Typically reports are structured as follows:
- Introduction and background
- Review of case documentation (including medical and other reports made available)
- Current situation
- Education and employment history
- Pre-injury employment and earnings prospects
- Post-injury employment and earnings prospects
- Summary and conclusions
Reports will be completed to meet the specific requirements of instructions received and the report format may be adjusted to account for this.
For initial reports a standard fee is charged. Subsequent reports and other work will be charged by the hour. There is a set fee for court attendance but cancellation fees only apply if notification that attendance at court is no longer required is received during the week of Proof. A schedule of fees will be supplied on request.
Doug accepts around 70 new instructions per annum.
